1. Background
Thank you for visiting our Site.
This Site is owned and operated by MK Ecco Pty Ltd (ABN 89 661 329 595, ACN 661 329 595) trading as CookDineHost ("CookDineHost"). These terms and conditions ("Terms") govern your access to and use of the Site.
In these Terms, "we", "our" and "us" refer to MK Ecco Pty Ltd trading as CookDineHost and "you" or "your" means the person who accesses or uses the Site or places an Order.
Please read these Terms carefully before accessing or using our Site. By using the Site, including by placing an Order for Products, you agree to these Terms. If you do not agree, you must not use the Site.
Any new features or tools added to the Site are also subject to these Terms. We may update these Terms from time to time. The current version and its last-updated date will be published on this page. Changes will apply from publication and will not affect rights or obligations that have already arisen in relation to a confirmed Order.
2. Definitions
Content: all material and information published on the Site, including text, links, graphics, logos, audio and software.
Intellectual Property: all intellectual property rights of any nature, whether registered or unregistered, including copyright, trade marks, business names, domain names, designs, patents and trade secrets.
Order: an order for one or more Products made through the Site.
Products: products listed for sale on the Site from time to time.
Site: cookdinehost.com and systems and Content used in connection with that website.
Privacy Policy: the CookDineHost Privacy Policy, as updated from time to time.
References to the singular include the plural and references to legislation include amendments, replacements and successor legislation. Headings are for convenience only.
3. Site Use
You may access and use the Site for lawful personal use. The Site and its Content are provided on an "as is" and "as available" basis, subject to rights that cannot be excluded by law.
You are responsible for having internet access and compatible devices and systems. We may change technical requirements or Site functionality from time to time.
You are responsible for taking reasonable precautions to protect your devices and systems from harmful code or interference. To the extent permitted by law, we are not responsible for damage to your systems caused by matters outside our reasonable control.
You may link to our Site provided the link is lawful, does not damage our reputation and does not falsely suggest an association, approval or endorsement.
4. Unacceptable Activity
You must not use the Site in a way that is unlawful, inappropriate or harmful. This includes:
- breaching these Terms or applicable law;
- breaching another person’s legal rights;
- infringing CookDineHost or third-party Intellectual Property rights;
- misusing, hacking, reverse-engineering, circumventing or disrupting the Site or its security or systems; or
- posting or transmitting unlawful, defamatory, obscene, threatening, malicious or otherwise harmful material.
We may restrict or suspend access to the Site where reasonably necessary to protect the Site, our customers, our business or third parties, or to comply with law.
5. Promotions and Competitions
From time to time, we may run promotions or competitions subject to additional terms. Those additional terms will apply to the relevant promotion or competition. If there is an inconsistency between those terms and these Terms, the promotion-specific terms will apply to that promotion.
Unless the promotion-specific terms state otherwise, promotional codes:
- are non-transferable and not redeemable for cash;
- are limited to one promotional code per Order;
- cannot be combined with other offers;
- cannot be applied retrospectively to previous Orders;
- may be subject to minimum-spend requirements, expiry dates, product exclusions or other stated conditions; and
- may be withdrawn or varied before use, without affecting an Order already confirmed under the applicable promotion.
6. Social Media
Comments or statements made by users on our social media channels do not necessarily reflect our views. We may moderate or remove unlawful or inappropriate content.
7. Orders
You may place an Order through the Site subject to these Terms. By placing an Order, you agree to pay the applicable price and delivery charges and confirm that the information you provide is accurate and complete.
If you provide another person’s personal information for delivery or another purpose, you must have authority to provide that information.
Each confirmed Order forms a separate contract. We will send an order confirmation to the email address provided. If you ask us to cancel or amend an Order before it has been packed or dispatched, we will endeavour to assist but cannot guarantee that a change or cancellation will be possible.
We may cancel an Order before dispatch where reasonably necessary, including because of stock availability, pricing or website errors, suspected fraud or an inability to process payment. If we cancel an Order after payment has been taken, we will refund the amount paid for the cancelled Order.
8. Products, Pricing, Delivery Fees and Discounts
Product availability and prices may change before an Order is confirmed. Unless otherwise stated, prices and fees displayed for the Australian store are in Australian dollars. Pricing presented for other markets may be displayed or converted in another currency.
Once an Order is confirmed, the price and delivery fee applicable to that Order are fixed, subject to any agreed amendment, refund or adjustment.
Discounts and offers are subject to their stated terms and any applicable exclusions.
9. Payments and Verification
Available payment methods are displayed at checkout and may change from time to time. You must provide accurate billing and payment information and authorise the applicable payment provider to process the amount due for your Order.
We may request reasonable identity or age verification where required for particular Orders, products, delivery locations, payment verification or fraud prevention. If required information is not provided, we may be unable to process or dispatch the Order.
We will not dispatch an Order until required payment has been received or authorised.
10. Gift Cards
CookDineHost gift cards are available for purchase in Australia and are delivered electronically after payment is processed.
Gift cards may be used toward eligible Products on the Site. If the value of an Order is less than the available gift-card balance, the remaining balance can be used on a future eligible Order.
Gift cards are not redeemable for cash and are generally non-refundable except where required by law. Where a refund is due for an item purchased using a gift card, the applicable amount may be returned to the gift card or provided on a replacement gift card, as appropriate.
Gift cards are valid for 3 years from the date of issue unless a longer period is required by law. Any unused balance expires at the end of the applicable validity period.
Please treat gift cards like cash. We are not responsible for a gift card that is lost or used without permission except to the extent required by law. We may cancel or restrict a gift card in cases of suspected fraud or misuse, subject to applicable law.
11. Delivery
We aim to dispatch Orders promptly. Delivery timeframes are estimates and may be affected by circumstances outside our reasonable control.
You are responsible for providing an accurate and complete delivery address. If an Order is returned because the address supplied was incorrect or incomplete, additional delivery charges may apply.
International Orders may be subject to duties, taxes or other charges imposed by the destination country. Unless otherwise stated at checkout or required by law, these charges are the customer’s responsibility.

12. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
13. Returns, Replacements and Refunds
Faulty, Damaged, or Incorrect Items
If your item arrives faulty, damaged or different from what you ordered, please contact our Customer Service team as soon as possible after delivery so we can resolve it quickly. Where possible, we recommend notifying us within 7 days of delivery.
If your parcel appears to be lost in transit, please contact us and we'll investigate with the carrier before arranging an appropriate resolution.
To help us assess your claim, please contact our Customer Service team at support@cookdinehost.com with:
- Your order number
- The email address used to place the order
- Photos or videos of the issue (where applicable)
If your claim is approved, we'll provide a replacement, refund or store credit in accordance with your rights under applicable consumer law and our warranty policy.
Change of Mind Returns
We accept change-of-mind returns within 14 days of delivery provided:
- The item is unused and in its original condition, including original packaging in resalable condition.
- Proof of purchase is provided.
- You've contacted us to obtain a Return Authorisation.
Return shipping: Change-of-mind returns are sent at your own cost. We recommend using a tracked shipping service, as we're unable to accept responsibility for returns that are lost in transit before they reach us.
Please keep your tracking details until your return has been received and your refund has been processed.
Once we've received and inspected your return, we'll process your refund to your original payment method, less the original shipping charge (if applicable).
Refunds are processed within approximately 30 days and issued to the original payment method used at cookdinehost.com.

14. Privacy
Our Privacy Policy explains how we collect, hold, use and disclose personal information and forms part of these Terms.
15. Intellectual Property
Unless otherwise indicated, CookDineHost or its licensors own or have rights to the Intellectual Property in the Site and Content. You must not copy, modify, reproduce, republish, distribute or commercially exploit that Intellectual Property without permission, except as permitted by law.
16. Limitation of Liability
Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.
To the extent permitted by law, we are not liable for loss or damage arising from circumstances outside our reasonable control or from your misuse of the Site or Products.
17. Indemnity
To the extent permitted by law, you are responsible for loss, damage or reasonable costs we incur as a direct result of your unlawful use of the Site or material breach of these Terms.
18. Third-Party Links
The Site may contain links to third-party websites or services. We do not control or endorse third-party content or privacy practices and are not responsible for them.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed or read down to the extent necessary without affecting the remaining provisions.
20. Waiver
A delay or failure to exercise a right under these Terms does not constitute a waiver of that right.
21. Changes to These Terms
We may update these Terms from time to time. The current version will be published on the Site with the date it was last updated. Changes apply from publication and do not retrospectively alter rights or obligations that have already arisen in relation to a confirmed Order.
22. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Subject to any rights you may have under applicable consumer law, the courts of New South Wales and courts entitled to hear appeals from them have jurisdiction in relation to these Terms.
